In the following Terms and Conditions, 'The photographer' shall mean Iska Birnie trading as Iska’s Images. The Client(s), shall be those persons defined on the booking form. These terms and conditions cannot be varied in any way by the client(s) unless expressly agreed by the photographer in writing.
Copyright 
Any images or copies of images, whether stored digitally or otherwise and printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988.
It is contrary to the Act to copy, or allow to be copied by any means, an image created as part of this contract without the permission of the photographer in writing.
The photographer retains copyright for all images taken on any photoshoot, except for pre-agreed commercial shoots. Images are sold on a personal use license, this include those on CD/USB. With the all-inclusive packages, the client is able to make gifts and prints at home, however it is not permitted to sell them, edit them or enter them in to any competitions as your own. 
The photographer allows the client to upload the images to Facebook and/or personal websites, however before doing so, please let the photographer know, credit the photographer and only use ‘website ready images’ with a small watermark or copyright notice, this prevents anyone stealing them to sell on or promote themselves.
Website Display and Promotional Usage
The client hereby allows the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, websites, social media, sample albums etc. The photographer will aim to keep these images safe from any malicious activity but cannot be held liable or accountable for malicious actions carried out by persons other than Iska’s Images employees.
Liability
The Photographer shall not be liable for indirect loss or third-party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, the photographer's liability (if any) shall be limited to rectifying such defect.
Personal Accident
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
Waiver of liability: client expressly releases the photographer, her employees and agents from all claims, damages, and liabilities that may result from accidents or incidents that occur during the photo session. This waiver of liability includes waiver of any claim that may be a result of negligence.  
Licence
The Photographer shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. The Photographers’ judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.
Photographs and Images
All images supplied by Iska’s Images are produced to the highest standards using the best quality materials and latest processing techniques. However, all images will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. Iska’s Images cannot accept any responsibility for this gradual image deterioration. All pictures purchased are presumed to have been received in good condition unless the Client notifies Iska’s Images in writing of any discrepancy or error within 7 days of receipt.
Equine Sessions
If you choose, at your own discretion, to ride your horse without a riding hat (or any other essential equipment), you do so entirely at your own risk. The photographer accepts no responsibility for injury or damage caused to horse, rider, property or any other individual before, during or after the photo session.
Pet Portrait Sessions
It is your responsibility to tell the photographer, if you feel that the location or situation puts your pet or any individual in danger. If your dog needs to stay on lead or cannot do certain things (for medical or other reasons) you need to inform the photographer. If your animal is aggressive, you also require to inform the photographer to keep everybody safe.
The photographer has the right to stop the session, if they are concerned about the animals welfare, safety or behaviour during the session (no refunds provided).
Please note that no cameras of any kind will be permitted at our sessions.
Photography session
Our fees include travel expenses up to 20 miles from AB25. Locations further away are charged at 45 pence per mile after the first 20 miles.
Payment for portrait sessions and products
Pet portrait session fee: Full payment is required at the time of booking, the appointment can be changed up to 48 hours before the session. Booking fees are non-transferable and non-refundable.
Products: Products are payable in advance of ordering, a 10% discount will be available for orders placed during the viewing appointment (cash, card, bank transfer, payment plan). Please note that products will be ordered once the payment has cleared. Orders placed with the printing lab CANNOT be cancelled, amended or refunded. Products will be ready for collection or delivery approx. 2-3 weeks after ordering. You are not entitled to a refund of the portrait session, if you do not wish to purchase any images. Payment plans cannot be cancelled.
Cancellation
When a photo shoot is postponed to a later date, rather than cancelled, the photographer will retain the fee as long as the photographer can re-schedule for the new date and time. Where the photographer is able to re-book the date with an equivalent booking then no additional charge will be made.
No show: If for any reason after receiving your confirmation, you fail to attend your pet portrait session (or do not give notice), you will lose your full booking fee.
If inclement weather or other adverse conditions prevent the photoshoot from taking place, the photography in discussion with the client will rearrange for another date.
Prices
All services and/or goods are supplied at the current prices ruling at the time of each individual payment and are subject to change without prior notice. 
Refund Policy
Through discussions prior to the photo shoot the photographer aims to understand and interpret the clients wishes. However, the photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.
Storage of Images
Original digital images are kept on an active file for 1 year, after which the raw images are stored in a secure location (access to these images is solely limited to the photographer). Raw image files will not be deleted unless expressly requested to do so by the client.
Complaints
Any complaints should first be raised by the client with the photographer in writing within 7 days from the date of receipt of images.
 The Photographer reserves the right to amend these Terms and Conditions without prior notice.
